NYS Issues Notice on PPE Charges

The New York State Department of Financial Services (DFS) this week issued an advisory with regard to Personal Protective Equipment (PPE) charges from healthcare providers.

Our interpretation of this is that if an insurer authorizes providers to charge a PPE fee, the participating dentist/provider is allowed to bill and receive reimbursement from the insurer pursuant to their agreement.  If the insurer does not authorize a PPE fee, and the dentist/provider is a participating provider with that insurer, they are not allowed to balance-bill the insured patient a PPE fee.  Private-pay patients may, of course, be billed a PPE fee.
